Via Kashmir operates as a tourism and hospitality booking platform connecting travelers with verified local vendors for hotels, houseboats, cabs, horse rides, shikaras, and tour packages across Kashmir. Please read these Terms carefully before making any booking or using our services.

Definitions

“Platform”
Refers to the Via Kashmir website, mobile application, and all associated services and features.
“User” or “You”
Any individual or entity accessing or using Via Kashmir's services, including travelers, customers, and visitors.
“Service Provider”
Local vendors, hotels, houseboat operators, cab services, and tour operators listed on our platform.
“Booking”
A confirmed reservation made through Via Kashmir for any service offered on the platform.
“Services”
Hotels, houseboats, transportation (cabs), experiential activities (horse rides, shikara boats), and tour packages available for booking.

Acceptance of Terms

By creating an account, making a booking, or using any part of the Via Kashmir platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Refund Policy.

If you do not agree to these Terms, you must not use our platform or services. We reserve the right to modify these Terms at any time, and continued use of the platform after changes constitutes acceptance of the modified Terms.

User Eligibility

You must be at least 18 years of age to create an account and make bookings on Via Kashmir.

You must provide accurate, current, and complete information during registration and booking processes.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must comply with all applicable local, state, national, and international laws and regulations when using our services.

Booking Process & Confirmation

Search & Availability

All services listed on Via Kashmir are subject to real-time availability. Prices and availability are subject to change until full payment is received and booking confirmation is issued.

Booking Confirmation

Once you complete payment, you will receive an instant booking confirmation via email and SMS containing:

  • Unique booking reference number
  • Service provider details and contact information
  • Check-in/service date, time, and location details
  • Total amount paid and payment breakdown
  • Cancellation policy applicable to your booking

Payment Terms

All bookings require full payment at the time of reservation unless otherwise specified. We accept various payment methods including credit/debit cards, net banking, UPI, and digital wallets. All prices are quoted in Indian Rupees (INR) and include applicable taxes unless stated otherwise.

Vouchers & Check-In

You must present your booking voucher (digital or printed) along with valid government-issued photo identification at the time of check-in or service commencement. Please arrive 15-20 minutes before your scheduled departure or check-in time.

Pricing, Taxes & Fees

All prices displayed on the Via Kashmir platform are transparent and include the following components:

User Responsibilities

Accurate Information

Provide correct personal, contact, and travel details for all bookings.

Valid Documentation

Carry valid photo ID and required permits during travel and at check-in.

Timely Arrival

Arrive on time for scheduled services. Late arrivals may result in cancellation without refund.

Respectful Conduct

Treat service providers, staff, and fellow travelers with respect and courtesy.

Property Respect

Respect property and equipment. You may be liable for damage caused during your stay or service.

Travel Guidelines

Follow all local laws, customs, and travel advisories for the Kashmir region.

Limitation of Liability

Via Kashmir acts as an intermediary platform connecting travelers with independent service providers. We are not directly responsible for:

  • The quality, safety, or legality of services provided by third-party vendors
  • Acts of God, natural disasters, weather conditions, or force majeure events
  • Loss, theft, damage, or injury occurring during your travel or stay
  • Delays, cancellations, or modifications made by service providers
  • Inaccuracies in service provider descriptions or amenities (though we strive for accuracy)

Important: Via Kashmir's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific booking in question.

Intellectual Property Rights

All content on the Via Kashmir platform, including but not limited to text, graphics, logos, images, videos, software, and trademarks, is the property of Via Kashmir or its content suppliers and is protected by Indian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our platform without prior written permission from Via Kashmir.

Privacy & Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Via Kashmir, you consent to the collection and use of your information as described in our Privacy Policy. We implement appropriate security measures to protect your personal and payment information in accordance with applicable data protection laws.

Dispute Resolution

Consumer Forum

As a service provider under the Consumer Protection Act, 2019, customers have the right to file complaints with District, State, or National Consumer Commissions for issues related to service quality, overcharging, or unfair trade practices.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising from these Terms or your use of Via Kashmir shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir.

Account Termination

Via Kashmir reserves the right to suspend or terminate your account and access to our services at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate.

You may close your account at any time by contacting our support team. Upon termination, your right to use the platform will immediately cease, though certain provisions of these Terms will survive termination.

Modifications to Terms

Via Kashmir reserves the right to modify, update, or replace these Terms and Conditions at any time at our sole discretion. Changes will be effective immediately upon posting to our website or app.

Your continued use of the platform after any such changes constitutes acceptance of the new Terms. We recommend reviewing these Terms periodically for any updates.
